India: CGPDTM
restricts the number of request for expedited examination of Patent Application
The Office of the Controller General of Patents, Designs and
Trade marks (CGPDTM), India has released a public notice on June 14, 2016
stating that, the number of requests for expedited examination, under rule 24C
of Patent (Amendment Rules), 2016, received by the Patent Office till December
31, 2016 has been restricted to 1000.
The said limitation is imposed by the CGPDTM under sub- rule
13 of Rule 24C of Patent (Amendment) Rules, 2016. The said rule states that;
“24C. Expedited
examination of applications.-
…………
(13) Notwithstanding
anything contained in this rule, the Controller may limit the number of
requests for expedited examination to be received during the year by way of a
notice to be published in the official journal.
…………”
The said rule came into force on May 16, 2016.
The present public notice is issued to ensure that, the purpose
of expedited examination can be fulfilled and efficient working of CGPDTM’s
office can also be ensured.
Application for expedited examination can be filed under Form
18A, as given in the Patent (Amendment) Rules, 2016. The fee for filing an
application under Rule 24C is prescribed in entry 14A of Table I of the First Schedule
of the Patent (Amendment) Rules, 2016. Significantly, only e- filing option is
available for application under Rule 24C.
